U.S. Information Agency Voice of America and American Federation of State, County And Municipal Employees Local 1418 (Blackwell, Arbitrator), 0-AR-3075 (Decided February 26, 1999)


      The Arbitrator found that the Agency violated the parties' collective bargaining agreement by assigning work performed in Studios 1-19 by radio broadcast technicians in the Union's bargaining unit to non-unit employees in other locations. The Authority concluded that the Agency failed to establish that the award was deficient.

      The Authority rejected the argument that the arbitrator exceeded his authority. The Authority found that the award was responsive to the issue as stipulated. The Authority also rejected the allegations that the award failed to draw its essence form the agreement, that it was based on a nonfact and that it was ambiguous, contradictory, and impossible to implement.
