The complaint alleged that the Respondent violated section 7116(a)(1) and (8) of the Statute by refusing to provide the Union with certain information concerning the selection process that the Respondent used to fill a job vacancy for a bargaining unit position. The Authority adopted the Judge's findings, conclusions, and recommended order to the extent consistent with this decision.
In agreement with the Judge, the Authority found that the data requested by the Union was necessary within the meaning of section 7114(b)(4)(B) of the Statute and that the Respondent violated the Statute in refusing to provide the information sought. The Judge's recommended remedy was also adopted.
