U. S. Border Patrol, Livermore Sector. Dublin, California and AFGE, National Border Patrol Council, Local 2730, AFL-CIO, Case No. SF-CA-00599 (Decided December 18, 2002)

      The complaint alleged that the Respondent violated § 7116(a)(1) and (5) of the Federal Service Labor-Management Relations Statute by refusing to bargain over the impact and implementation of its decision to temporarily reassign two employees to different offices. The Judge concluded that the Respondent did not violate the Statute and recommended that the Authority dismiss the complaint.

      The Authority adopted the Judge's findings, conclusions and recommended order to the extent consistent with this decision. The Authority found that the Respondent did not violate § 7116(a)(1) and (5) of the Statute. Accordingly, the complaint was dismissed.
