National Treasury Employees Union and U. S. Department of the Treasury Internal Revenue Service, Washington, D.C. Case 0-NG-2667 (Decided September 9, 2003)

      This case concerned the negotiability of a provision disapproved by the Agency head under § 7114(c) of the Statute. The provision addresses situations where a temporary duty assignment required an employee to commute to a work site that within 40 miles of the employee's permanent post of duty. The Authority dismissed the petition for review.

      The Authority found that although the petition for review was timely filed the provision was inconsistent with a Government-wide regulation, thus contrary to law and properly disapproved by the Agency under § 7114(c) of the Statute.
