U.S. Dept. of Veterans Affairs Consolidated Mail Outpatient Pharmacy Dallas, Texas and AFGE, Local 2437 (Barnard, Arbitrator) 0-AR-3762 (Decided July 23, 2004)
The Arbitrator sustained the grievance and concluded that the Agency was required to abide by a provision of a local collective bargaining agreement. The Authority denied the Agency's exceptions.
Upon review, the Authority found that the award was not contrary to law. The Authority found that the Arbitrator evaluated the record and applied the correct legal standards to those facts and concluded that CMOP was required to abide by Article 7, Section 4 of the local agreement. The Authority further stated that as there was nothing in the record that demonstrates that the award was contrary to law, and concluded that the exception provided no basis for finding the award deficient.
