NTEU AND U.S. DEPT. OF HOMELAND SECURITY BUREAU OF CUSTOMS AND BORDER PROTECTION, Case NO. 0-NG-2793 (June 13, 2005)

This case  concerned the negotiability of one proposal concerning the wearing of cargo shorts by Customs Officers. The Agency filed a statement of position, to which the Union filed a response. The Agency did not file a reply to the Union's response. The Authority found that the proposal was within the duty to bargain.  The Authority found that the Proposal did not affect management's right to determine its internal security practices, nor that the proposal concerned matters  regarding the methods and means of performing work
