The Arbitrator denied a grievance concerning restoration of 31 hours of use-or-lose annual leave. The grievance alleged that the Agency's failure to restore the leave violated 5 U.S.C. § 6304(d). The Union filed exceptions contending that the Arbitrator's award was contrary to law.
The Authority denied the Union's exceptions, and found that the fact that the grievant's canceled leave was not rescheduled does not constitute "administrative error" within the meaning of § 6304(d)(1)(A). The Authority noted that the grievant was offered the chance to reschedule her leave, but she refused to do so.
