The Arbitrator found that the Agency did not create a hostile work environment in its investigation and discipline of the employee. The Union claimed the award is contrary to law, based on nonfacts, violates the agreement, and that the Arbitrator failed to address certain evidence.
As a preliminary matter, the Authority dismissed the Union's due process exceptions because it raises matters that could have been, but were not, raised to the Arbitrator. Thereafter, the Authority denied the remaining exceptions.
