                    DECISION AND DIRECTION OF ELECTION
 
    UPON A PETITION DULY FILED WITH THE FEDERAL LABOR RELATIONS AUTHORITY
 UNDER SECTION 7112(D) OF THE FEDERAL SERVICE LABOR-MANAGEMENT RELATIONS
 STATUTE, 5 U.S.C.  7101-7135, A HEARING WAS HELD BEFORE A HEARING
 OFFICER OF THE AUTHORITY.  THE AUTHORITY HAS REVIEWED THE HEARING
 OFFICER'S RULINGS MADE AT THE HEARING AND FINDS THAT THEY ARE FREE FROM
 PREJUDICIAL ERROR.  THE RULINGS ARE HEREBY AFFIRMED.
 
    UPON THE ENTIRE RECORD IN THIS CASE, INCLUDING BRIEFS FILED BY BOTH
 PARTIES, THE AUTHORITY FINDS:
 
    THE PETITIONER, THE AMERICAN FEDERATION OF GOVERNMENT EMPLOYEES,
 AFL-CIO (PETITIONER), FILED THE INSTANT UNIT CONSOLIDATION (UC) PETITION
 SEEKING TO CONSOLIDATE THE 69 UNITS (AS SET FORTH IN APPENDIX I) WITHIN
 THE ARMY AND AIR FORCE EXCHANGE SERVICE (AAFES) FOR WHICH CERTAIN OF ITS
 CONSTITUTENT LOCALS ARE THE CURRENT EXCLUSIVE REPRESENTATIVES.  THE UNIT
 SOUGHT WOULD CONSIST OF ALL THE EMPLOYEES OF THE AAFES REPRESENTED BY
 THE PETITIONER.
 
    THE AAFES CONTENDS THAT THE PROPOSED CONSOLIDATED UNIT IS NOT
 APPROPRIATE FOR THE PURPOSE OF EXCLUSIVE RECOGNITION BECAUSE IT DOES NOT
 MEET THE CRITERIA ESTABLISHED BY SECTION 7112(A)(1) OF THE STATUTE.  /1/
 IN THIS REGARD, THE AAFES ARGUES THAT THE EMPLOYEES IN THE PETITIONED
 FOR UNIT DO NOT SHARE A "CLEAR AND IDENTIFIABLE COMMUNITY OF INTEREST"
 AND THAT THE UNIT SOUGHT WOULD NOT "PROMOTE" EFFECTIVE DEALINGS AND
 EFFICIENCY OF THE AGENCY'S OPERATIONS.  IT ALSO CONTENDS THAT THE ONLY
 BASIS FOR THE UNIT SOUGHT SEEMS TO BE THE PETITIONER'S EXTENT OF
 ORGANIZATION, A BASIS WHICH WOULD BE CONTRARY TO THE INTENT OF SECTION
 7112(B) OF THE STATUTE.  /2/ THE PETITIONER, ON THE OTHER HAND, CONTENDS
 THAT THE PROPOSED UNIT MEETS THE THREE CRITERIA ESTABLISHED IN SECTION
 7112(A)(1) AND THAT THE UNIT WOULD PROMOTE A MORE COMPREHENSIVE
 BARGAINING UNIT STRUCTURE CONSISTENT WITH THE PURPOSES OF THE STATUTE,
 CITING THE CASES ISSUED UNDER THE EXECUTIVE ORDER PROGRAM.
 
    THE AAFES IS A NON-APPROPRIATED FUND INSTRUMENTALITY OF THE UNITED
 STATES GOVERNMENT AND A PRIMARY NATIONAL SUBDIVISION OF THE DEPARTMENT
 OF DEFENSE.  /3/ ITS PRIMARY MISSION IS TO PROVIDE MERCHANDISE AND
 SERVICES OF NECESSITY AND CONVENIENCE WHICH ARE NOT FURNISHED FROM
 APPROPRIATED FUNDS TO AUTHORIZED PATRONS AT UNIFORMLY LOW PRICES AND TO
 GENERATE REASONABLE EARNINGS TO SUPPLEMENT APPROPRIATED FUNDS FOR THE
 SUPPORT OF ARMY AND AIR FORCE WELFARE RECREATIONAL PROGRAMS.  THE AAFES
 HAS ITS WORLD-WIDE HEADQUARTERS IN DALLAS, TEXAS.  IT IS A JOINT COMMAND
 OF THE ARMY AND AIR FORCE, CURRENTLY UNDER THE COMMAND OF A BRIGADIER
 GENERAL OF THE ARMY.  AAFES EMPLOYS APPROXIMATELY 62,500 CIVILIAN
 EMPLOYEES WORLD-WIDE.  IT HAS APPROXIMATELY 21,000 EMPLOYEES REPRESENTED
 IN 110 BARGAINING UNITS BY SOME 14 SEPARATE LABOR ORGANIZATIONS.  OF
 THESE, THE PETITIONER REPRESENTS SOME 12,000 EMPLOYEES IN THE 69 UNITS
 WHICH IT IS HEREIN ATTEMPTING TO CONSOLIDATE.
 
    IN THE CONTINENTAL UNITED STATES THE AAFES IS DIVIDED INTO FIVE
 EXCHANGE REGIONS-- ALAMO EXCHANGE REGION, CAPITOL EXCHANGE REGION,
 GOLDEN GATE EXCHANGE REGION, OHIO VALLEY EXCHANGE REGION, AND THE
 SOUTHEAST EXCHANGE REGION-- AND TWO DISTRIBUTION RATIONS-- EASTERN AND
 WESTERN.  EACH REGION IS HEADED BY A REGIONAL CHIEF WHO REPORTS DIRECTLY
 TO THE COMMANDER, AAFES.  THE EXCHANGE REGIONS ARE COMPRISED OF SEVERAL
 AREA EXCHANGES, EACH HEADED BY A GENERAL MANAGER AND EACH AREA EXCHANGE
 CONSISTS OF SEVERAL POST OR BASE EXCHANGES HEADED BY EXCHANGE MANAGERS.
 EACH DISTRIBUTION REGION IS COMPRISED OF SEVERAL GENERAL MERCHANDISING
 DISTRIBUTION ACTIVITIES LOCATED AT VARIOUS GEOGRAPHIC LOCATIONS AND
 HEADED BY A DISTRIBUTION FACILITIES MANAGER WHO REPORTS TO THE
 RESPECTIVE DISTRIBUTION FACILITIES MANAGER WHO REPORTS TO THE RESPECTIVE
 DISTRIBUTION REGION CHIEF.  AAFES-- EUROPE AND AAFES-- PACIFIC ARE
 INDEPENDENT ENTITIES WHICH REPORT DIRECTLY TO THE COMMANDER, AAFES.
 BASICALLY, THE AAFES COMMAND EMPLOYEES IN DALLAS, THE REGIONAL OFFICE
 EMPLOYEES, AND THE EMPLOYEES OF HEADQUARTERS, AAFES-- EUROPE AND AAFES--
 PACIFIC, PROVIDE STAFF FUNCTIONS IN SUCH AREAS AS PERSONNEL,
 CONTRACTING, ADMINISTRATIVE SERVICES, ENGINEERING, FINANCE AND
 ACCOUNTING, AND DATA PROCESSING.  THE POST OR BASE EXCHANGES ARE
 CONCERNED PRIMARILY WITH THE SALE OF MERCHANDISE AND SERVICES AT THE
 RETAIL CUSTOMER LEVEL.  THE DISTRIBUTION ACTIVITIES ARE RESPONSIBLE FOR
 ASSEMBLING, RECEIVING, MARKING, WAREHOUSING AND TRANSPORTING GOODS TO
 THE VARIOUS STORES FOR SALE TO THE CUSTOMERS.
 
    BASICALLY, THE AAFES EMPLOYMENT PROFILE CONSISTS OF STAFF EMPLOYEES
 FOUND PRIMARILY AT THE HEADQUARTERS OFFICES, THE REGIONS, AND THE AREA
 EXCHANGES, WHO ARE DESIGNATED UNIVERSAL ANNUAL SALARY PLAN (UA)
 EMPLOYEES AND WHO ARE SIMILAR TO GENERAL SCHEDULE EMPLOYEES IN THE CIVIL
 SERVICE, WHILE THE VAST MAJORITY OF THE EMPLOYEES AT THE BASE EXCHANGES
 AND/OR DISTRIBUTION ACTIVITIES ARE HOURLY PAY PLAN (HPP) EMPLOYEES, WHO
 ARE THE EQUIVALENT OF WAGE GRADE EMPLOYEES IN THE CIVIL SERVICE.  THE
 EVIDENCE INDICATES THAT PERSONNEL AND LABOR RELATIONS AUTHORITY FOR
 AAFES IS ESTABLISHED BY AAFES REGULATIONS PREPARED FOR AND PROMULGATED
 BY THE COMMANDER, AAFES.  THESE REGULATIONS OUTLINE IN GREAT DETAIL THE
 PARAMETERS WITHIN WHICH THE FIELD LEVEL MANAGERS OF AAFES FACILITIES ARE
 CONSTRAINED TO OPERATE.  ASIDE FROM ISSUING THE REGULATIONS WHICH AFFECT
 ALL OF AAFES' EMPLOYEES, AAFES HEADQUARTERS ALSO ISSUES ALL POSITION
 DESCRIPTIONS FOR AAFES EMPLOYEES AND IS RESPONSIBLE FOR DOWNGRADING,
 RELOCATION AND REDUCTION IN FORCE ACTIONS FOR ALL UA EMPLOYEES OF THE
 AAFES.  WHILE THE EVIDENCE INDICATES THAT MANY DAY TO DAY DECISIONS
 AFFECTING EMPLOYEES ARE MADE BY BASE EXCHANGE MANAGERS, IT IS ALSO CLEAR
 THAT MOST NON-ROUTINE DECISIONS AFFECTING SUCH EMPLOYEES, PARTICULARLY
 IN THE AREA OF PERSONNEL AND LABOR RELATIONS, ARE MADE, OR AT LEAST
 REVIEWED AND APPROVED, AT THE AREA EXCHANGE OR HIGHER LEVELS.  IN THIS
 REGARD, THE RECORD SHOWS THAT WHILE STAFFING RECOMMENDATIONS ARE MADE AT
 THE EXCHANGE LEVEL, FINAL DECISIONS ARE MADE BY THE REGIONS.  THE
 GENERAL MANAGERS OF THE AREA EXCHANGES EXERCISE THE AUTHORITY TO HIRE
 AND FIRE, AS WELL AS PROVIDING TRAINING, FOR EXCHANGE EMPLOYEES.  IN THE
 AREA OF LABOR RELATIONS, THE RECORD INDICATES THAT NEGOTIATIONS FOR THE
 VARIOUS EXCHANGES WHERE RECOGNITION EXISTS ARE HANDLED BY REGIONAL
 REPRESENTATIVES OF THE AAFES, EXCEPT FOR THE ALAMO REGION, WHERE SUCH
 SERVICES ARE PROVIDED BY THE AAFES HEADQUARTERS STAFF.  FURTHERMORE, THE
 REGIONAL REPRESENTATIVES WOULD HAVE TO BE INVOLVED IN ANY GRIEVANCE
 ARISING AT AN EXCHANGE BEFORE IT COULD BE TAKEN TO THE THIRD STEP OF THE
 GRIEVANCE PROCEDURE, THE REGIONAL REPRESENTATIVE WOULD HANDLE ALL UNFAIR
 LABOR PRACTICE MATTERS, AND THE REGIONAL REPRESENTATIVE WOULD MAKE ANY
 NEGOTIABILITY, COMPELLING NEED, OR UNIT DETERMINATION DECISIONS FOR AN
 EXCHANGE.  IN ALL SUCH MATTERS, THE REGIONAL REPRESENTATIVE SEEKS THE
 ACTIVE ADVICE OF THE LABOR RELATIONS LAW BRANCH OF AAFES' GENERAL
 COUNSEL'S OFFICE.  THE EVIDENCE ALSO INDICATED THAT MEMBERS OF THE LABOR
 RELATIONS LAW BRANCH HAVE BEEN INVOLVED IN THE TRAINING OF THE REGIONAL
 REPRESENTATIVES, THEY HAVE APPEARED AS REPRESENTATIVES OF AAFES
 FACILITIES AT THIRD-PARTY PROCEEDINGS, AND AAFES REGULATION AR-6021
 REQUIRES THAT ALL UNFAIR LABOR PRACTICE COMPLAINTS FILED BY AAFES MUST
 BE FILED BY THE GENERAL COUNSEL'S OFFICE.
 
    IN DEPARTMENT OF TRANSPORTATION, 5 FLRA NO. 89, THE AUTHORITY NOTED
 THAT SECTION 7112(A)(1) REQUIRES THAT ANY UNIT FOUND APPROPRIATE MUST
 CONFORM TO THE THREE CRITERIA ESTABLISHED BY THAT SECTION -- A CLEAR AND
 IDENTIFIABLE COMMUNITY OF INTEREST AMONG THE EMPLOYEES IN THE UNIT, AND
 THE PROMOTION OF EFFECTIVE DEALINGS WITH, AND THE EFFICIENCY OF THE
 OPERATIONS OF, THE AGENCY INVOLVED.  THE AUTHORITY FURTHER NOTED THAT
 SECTION 7112(D), WHICH PROVIDES FOR THE CONSOLIDATION OF EXISTING UNITS,
 MUST MEET THE SAME THREE CRITERIA SET FORTH IN SECTION 7112(A)(1) AS ARE
 REQUIRED OF ANY UNIT FOUND APPROPRIATE.  APPLYING THE FIRST OF THESE
 CRITERIA, COMMUNITY OF INTEREST, TO THE INSTANT MATTER, THE AUTHORITY
 NOTES THAT THE PETITIONED FOR CONSOLIDATED UNIT WOULD INCLUDE ALL OF THE
 EMPLOYEES OF AAFES WHO ARE REPRESENTED BY THE PETITIONER.  EACH OF THE
 MAJOR ORGANIZATIONAL ELEMENTS OF AAFES WHICH ARE SUBORDINATE TO THE
 COMMANDER, AAFES WOULD BE REPRESENTED WITHIN THE PROPOSED UNIT.  THAT
 IS, SOME EMPLOYEES FROM HEADQUARTERS, AAFES;  HEADQUARTERS, AAFES--
 EUROPE;  HEADQUARTERS, AAFES PACIFIC;  AND FROM EACH OF THE FIVE
 CONTINENTAL UNITED STATES EXCHANGE REGIONS AND THE TWO DISTRIBUTION
 REGIONS, WOULD BE REPRESENTED WITHIN THE PROPOSED UNIT.  THE PROPOSED
 CONSOLIDATED UNIT WOULD CONSIST OF APPROXIMATELY 12,000 OF THE 21,000
 AAFES EMPLOYEES WHO ARE CURRENTLY REPRESENTED IN EXCLUSIVE BARGAINING
 UNITS.
 
    IN THE CIRCUMSTANCES OF THIS CASE, THE AUTHORITY CONCLUDES THAT THE
 UNIT SOUGHT BY THE PETITIONER WILL ENSURE A CLEAR AND IDENTIFIABLE
 COMMUNITY OF INTEREST AMONG THE EMPLOYEES WHO WOULD BE REPRESENTED
 THEREIN.  IN SO CONCLUDING, THE AUTHORITY NOTES THAT THE EMPLOYEES WHO
 WOULD BE INCLUDED IN THE PROPOSED UNIT ARE SUFFICIENTLY WELL DISTRIBUTED
 THROUGHOUT THE ORGANIZATIONAL AND GEOGRAPHICAL ELEMENTS WHICH MAKE UP
 AAFES SO AS TO CONSTITUTE A MEANINGFUL CONSOLIDATED UNIT OF ALL AAFES
 EMPLOYEES WHO ARE REPRESENTED BY THE PETITIONER.  THUS, AS NOTED ABOVE,
 EMPLOYEES FROM EACH OF AAFES' MAJOR GEOGRAPHICAL AND ORGANIZATIONAL
 COMPONENTS WOULD BE REPRESENTED IN THE PROPOSED UNIT.  IN THIS REGARD,
 THE AUTHORITY NOTES THAT AAFES IS AN INTEGRATED ORGANIZATION WITH
 BASICALLY A SINGLE PRIMARY MISSION, PROVIDING RETAIL FACILITIES FOR
 ELIGIBLE USERS, AND THUS ITS EMPLOYEES ARE ENGAGED IN RELATIVELY SIMILAR
 FUNCTIONAL AND OCCUPATIONAL UNDERTAKINGS THROUGHOUT THE ORGANIZATION.
 THE EMPLOYEES OF AAFES SHARE A COMMON MISSION, COMMON JOB
 CLASSIFICATIONS AND COMMON WORKING CONDITIONS, AND THEY WORK UNDER
 SIMILAR PERSONNEL AND LABOR RELATIONS POLICIES ESTABLISHED BY AAFES
 REGULATIONS ADMINISTERED UNDER THE DIRECTION OF THE COMMANDER, AAFES.
 IN THIS REGARD, THE AUTHORITY NOTES THAT THE OVERSEAS COMMANDS AND THE
 REGIONS OF AAFES ARE ADMINISTRATIVE AND GEOGRAPHICAL SUBDIVISIONS OF THE
 AGENCY WHICH ARE ENGAGED IN PRIMARILY THE SAME MISSION, PROVIDING RETAIL
 SERVICES TO MEMBERS OF THE MILITARY AND THEIR DEPENDENTS. WHILE THE
 AAFES POINTED OUT THE DISTINCT ROLE PLAYED BY THE DISTRIBUTION REGIONS,
 IT IS CLEAR THAT THEIR FUNCTION IS INTEGRALLY RELATED TO THAT OF THE
 EXCHANGE REGIONS AND THAT MANY OF THE UNIT EMPLOYEES' CLASSIFICATIONS
 SUCH AS WAREHOUSEMAN, MOTOR VEHICLE OPERATOR AND DISTRIBUTION CLERK, ARE
 FOUND THROUGHOUT BOTH KINDS OF ACTIVITIES.  ADDITIONALLY, WHILE THERE IS
 LITTLE FORMAL TRANSFER OR INTERCHANGE, THE EVIDENCE INDICATES THAT MANY
 OF THE EXCHANGE EMPLOYEES ARE MILITARY OR MILITARY DEPENDENTS WHO MOVE
 FREQUENTLY FROM ONE BASE WITH AN AAFES FACILITY TO ANOTHER, WHERE SOME
 30 TO 40 PERCENT GAIN REEMPLOYMENT WITH AAFES.  BASED ON THE FOREGOING
 CONSIDERATIONS, THE AUTHORITY CONCLUDES THAT THE PROPOSED CONSOLIDATED
 UNIT.
 
    IN REGARD TO WHETHER THE PETITIONED FOR CONSOLIDATED UNIT WOULD
 PROMOTE EFFECTIVE DEALINGS WITH, AND THE EFFICIENCY OF OPERATIONS OF,
 THE AAFES, THE AUTHORITY NOTES THE PRESENT CENTRALIZATION OF PERSONNEL
 AND LABOR RELATIONS AUTHORITY EXTANT WITHIN AAFES, INCLUDING THE PRIMACY
 OF AAFES REGULATIONS ISSUED BY THE COMMANDER, AAFES AND THE ROLE PLAYED
 BY THE LABOR RELATIONS LAW BRANCH OF THE GENERAL COUNSEL'S OFFICE
 OUTLINED ABOVE.  FURTHERMORE, WHILE MOST OF THE PETITIONER'S
 RECOGNITIONS WHICH IT SEEKS TO CONSOLIDATE HEREIN ARE AT THE EXCHANGE OR
 ACTIVITY LEVEL, THE AAFES CONCEDES THAT DAY TO DAY PERSONNEL AND LABOR
 RELATIONS MATTERS ARE PRIMARILY CONDUCTED BY REGIONAL AND AREA
 REPRESENTATIVES WHO ARE NOT AT THE LEVEL OF THE CURRENT EXCLUSIVE
 RECOGNITIONS.  BASED ON THESE FACTORS, WHICH INCLUDE THE CENTRALIZATION
 OF PERSONNEL AND LABOR RELATIONS FUNCTIONS AND POLICIES AT THE NATIONAL
 LEVEL OF THE AAFES, AND THE ESTABLISHMENT OF BROAD OPERATING POLICIES
 FOR THE AAFES AT THE NATIONAL LEVEL, THE AUTHORITY FINDS THAT THE
 PROPOSED CONSOLIDATED UNIT WILL PROMOTE EFFECTIVE DEALINGS AND
 EFFICIENCY OF THE AGENCY'S OPERATIONS.  FURTHER, THE AUTHORITY CONCLUDES
 THAT EFFECTIVE DEALINGS AND THE EFFICIENCY OF THE AGENCY'S OPERATIONS
 WILL BE ENHANCED BY THE PROPOSED CONSOLIDATED UNIT, WHICH COVERS ALL OF
 THE EMPLOYEES REPRESENTED BY THE AFGE WITHIN THE AAFES, AS IT WILL
 PROVIDE FOR BARGAINING IN A SINGLE UNIT RATHER THAN IN THE EXISTING 69
 BARGAINING UNITS, THEREBY REDUCING FRAGMENTATION AND PROMOTING A MORE
 EFFECTIVE, COMPREHENSIVE BARGAINING UNIT STRUCTURE TO EFFECTUATE THE
 PURPOSES OF THE STATUTE.
 
    ACCORDINGLY, THE AUTHORITY FINDS THAT THE PETITIONED FOR CONSOLIDATED
 UNIT, CONSISTING OF THE EMPLOYEES AS SET FORTH IN APPENDIX I, IS
 APPROPRIATE FOR THE PURPOSE OF EXCLUSIVE RECOGNITION UNDER THE STATUTE.
 
                           DIRECTION OF ELECTION
 
    AN ELECTION BY SECRET BALLOT SHALL BE CONDUCTED AMONG THE EMPLOYEES
 IN THE UNIT FOUND APPROPRIATE AS SOON AS POSSIBLE, BUT NOT LATER THAN 60
 DAYS FROM THE DATE BELOW.  THE APPROPRIATE REGIONAL DIRECTOR SHALL
 SUPERVISE THE ELECTION, SUBJECT TO THE AUTHORITY'S RULES AND
 REGULATIONS.  ELIGIBLE TO VOTE ARE THOSE IN THE VOTING GROUP WHO WERE
 EMPLOYED DURING THE PAYROLL PERIOD IMMEDIATELY PRECEDING THE DATE BELOW,
 INCLUDING EMPLOYEES WHO DID NOT WORK DURING THAT PERIOD BECAUSE THEY
 WERE OUT ILL, OR ON VACATION, OR ON FURLOUGH, INCLUDING THOSE IN
 MILITARY SERVICE WHO APPEAR IN PERSON AT THE POLLS.  INELIGIBLE TO VOTE
 ARE EMPLOYEES WHO HAVE QUIT OR WERE DISCHARGED FOR CAUSE SINCE THE
 DESIGNATED PAYROLL PERIOD AND WHO HAVE NOT BEEN REHIRED OR REINSTATED
 BEFORE THE ELECTION DATE.  THOSE ELIGIBLE SHALL VOTE WHETHER OR NOT THEY
 DESIRE TO BE REPRESENTED IN THE PROPOSED CONSOLIDATED UNIT BY THE
 AMERICAN FEDERATION OF GOVERNMENT EMPLOYEES, AFL-CIO.

    ALL REGULAR FULL-TIME AND REGULAR PART-TIME CIVILIAN HOURLY PAY PLAN
 AND UNIVERSAL SALARY PLAN EMPLOYEES, INCLUDING OFF-DUTY MILITARY
 PERSONNEL IN EITHER OF THE FOREGOING CATEGORIES, EMPLOYED BY THE ARMY
 AND AIR FORCE EXCHANGE SERVICE AT ITS HEADQUARTERS IN DALLAS, TEXAS,
