ORDER GRANTING WITHDRAWAL OF APPLICATION FOR REVIEW

This case is before the Authority on an application for review filed by the American Federation of Government Employees, Local 2747 (AFGE), the Petitioner in Case No. BY-RO-20029, under section 2422.17(a) of the Authority's Rules and Regulations.

In its petition before the Regional Director (RD), AFGE sought an election in a unit of all nonprofessional employees of the Defense Commissary Agency, Governors Island Commissary, Governors Island, New York (the Activity). In his decision and order in Case No. BY-RO-20029, the RD found that the unit sought by AFGE was not appropriate under section 7112(a)(1) of the Federal Service Labor-Management Relations Statute and he dismissed AFGE's petition. AFGE sought review of the RD's decision in Case No. BY-RO-20029.

By order of February 3, 1994, the Authority granted AFGE's application for review and allowed the parties time to file briefs. Defense Commissary Agency, Fort Monroe, Virginia, 49 FLRA 3 (1994). Neither AFGE nor the Activity filed a brief with the Authority.

On March 7, 1994, AFGE filed a motion to withdraw its application for review. Pursuant to section 2422.17(g) of its Rules and Regulations, the Authority grants AFGE's motion to withdraw its application for review. The Authority will not take further action on the application for review.
